Terms of Service
The rules for using Louder. They apply to everyone with an account.
Louder is operated by LOUDERADIO PTY LTD (ACN 701 085 967, ABN 82 701 085 967), Melbourne, Australia.
By creating an account you accept these terms. If you claim an artist page the Artist Agreement also applies, and if you claim a venue the Venue Terms also apply.
1. What Louder is
A map of live music. It shows what is on near you, lets acts and venues claim and run their own pages, and will play music by acts booked to play nearby once we hold the licence to do so.
Louder is free to use. It is paid for by advertising, and by optional memberships that unlock nothing.
2. Accounts and minimum age
You must be at least 16 years old to hold a Louder account. If you are under 18, please make sure a parent or guardian is happy for you to use it. If we learn that an account holder is under 16, we will close the account and delete the personal information attached to it.
You are responsible for what happens on your account and for keeping your password to yourself. Tell us promptly if you think someone else has access.
Some things need a confirmed email address, including claiming a venue by its own domain. That is deliberate: a claim to an inbox is not the same as possession of one.
3. Age and advertising
Some advertising is not suitable for everyone. Every ad on Louder carries a category which sets a minimum age, and that rule is enforced in our database rather than only in the app, so it applies however the ad is requested.
We ask your date of birth when you sign up so we can apply it. If we do not know your age, you are treated as the youngest audience, not the oldest. Giving us a false date of birth to reach age-restricted advertising is a breach of these terms.
4. What you may not do
- Claim a band or venue you have no right to claim.
- Upload anything you do not have the rights to.
- Post anything unlawful, misleading, defamatory, or that infringes someone's rights.
- List gigs that are not happening, at venues that have not agreed to them.
- Interfere with the service, or try to access data that is not yours, including by automated means.
- Scrape, bulk download or redistribute our listings as a dataset.
5. Content you upload
You keep ownership of everything you upload. What we may do with it is set out in the Artist Agreement for music, and clause 4 of the Venue Terms for venue material.
We may remove content that breaches these terms or that someone with a credible claim asks us to remove. Where we can, we will tell you first.
6. Listings we build ourselves
Louder builds pages from what venues, promoters and gig guides publish publicly. We try hard to get it right and we correct things when we are told they are wrong, but we do not guarantee that a listing is accurate, current or complete.
Check before you travel. Gigs move and get cancelled, and we may not hear about it. Confirm with the venue before making a trip that matters.
If a listing about you or your business is wrong, tell us and we will fix it. If you would rather not be listed at all, see clause 6 of the Venue Terms.
7. Membership
Membership is a voluntary contribution. It unlocks nothing: no advertising is removed, no features are unlocked, and no placement is improved. Everything on Louder is free without it.
Where membership is available, it is billed monthly in advance through Stripe. You may cancel at any time and your membership runs to the end of the period you have paid for. Because it buys no service, we do not refund part periods except where the Australian Consumer Law requires it. Louder never sees or stores your card details.
8. Ending it
You may close your account at any time. We may suspend or close an account that seriously or repeatedly breaches these terms, and we will tell you why unless we are prevented from doing so.
9. Liability
Louder is provided as it is. We do not promise it will be uninterrupted, error free, or that listings are accurate. To the extent permitted by law we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you have paid us in the previous twelve months, which for most people is nothing.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under that law.
10. Changes and law
We may update these terms. Material changes are notified by email before they take effect, and continuing to use Louder afterwards means you accept them.
These terms are governed by the law of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria.
